Cassowary Coast Regional Council has adopted a new planning scheme, which took effect on 3 July 2015.  The Cassowary Coast Planning Scheme 2015 regulates land use and development across the Region and delivers Council's local planning aspirations for the Region.  The Planning Scheme provides a consistent planning regime across the whole Council area, replacing the Johnstone Shire Planning Scheme 2005 and Cardwell Shire Planning Scheme 2007.

Superseded Planning Schemes

A superseded planning scheme is a planning scheme that was in force immediately before a new planning scheme takes effect.  On 3 July 2015, the Cassowary Coast Planning Scheme 2015 replaced the Johnstone Shire Planning Scheme 2005 and the Cardwell Shire Planning Scheme 2007.  Therefore, the Johnstone Shire Planning Scheme 2005 and Cardwell Shire Planning Scheme 2007 are now superseded planning schemes.

In accordance with Section 95 of the Sustainable Planning Act 2009, a person may ask Council to assess a development proposal under the relevant superseded planning scheme.  The request must be made within one (1) year of the date the Cassowary Coast Planning Scheme took effect, being 3 July 2015.  The request must be accompanied by the relevant fee and form.
