Council statement re Myroo Group and Clump Point boating facility

When Myroo Group Pty Ltd commenced operating from the Clump Point boating facility, Cassowary Coast Regional Council granted it a licence to occupy pen berth 1. Myroo chose to berth on the northern side of the southern pontoon.
When Myroo’s agreement was up for renewal, they requested that their berth be changed from pen berth 1 to the southern pontoon.
The Queensland Government built and own this facility.
Council manages the facility on behalf of the Queensland Government, and we are required to follow their Clump Point Boating Facility – Operational Management Plan.
The operational plan requires the southern pontoon to be free for use by commercial and recreational users for up to 30 minutes to load and unload passengers and cargo.
It also requires the northern side of the southern pontoon to be used for refuelling. The fuel bunded area is immediately above this location, and it is the only permitted refuelling area in the whole facility.
This facility is also located within the Great Barrier Reef Marine Park, and there are important environmental and sustainability considerations, as well as legislative requirements, with regards to this refuelling area that Council and the Queensland Government must adhere to.
The facility’s popularity, commercial activity, and usage is increasing, and we have an obligation to ensure the facility is accessible for all users and to enforce the Queensland Government’s operational requirements.
For these reasons, under Queensland Government’s rules, the Council is unable to grant Myroo’s request. Under these rules, Myroo can only berth their vessel at the southern pontoon to refuel, and to load and unload passengers and cargo.
Myroo is still allowed to continue to use pen berth 1.
We have reached out to Myroo to discuss the situation further.
Myroo may also wish to contact the Queensland Government to discuss their request.
We are aware some operators are considering constructing their own pontoons, and that is a possible option for Myroo to consider.
Council has previously raised our concerns with the Queensland Government about access for vessels berthed in the pen berths.
Council has also asked the Queensland Government to upgrade the facility and install access pontoons to the pen berths, which would benefit multiple operators, and we will continue to advocate on behalf of operators on this.
